These Terms and Conditions ("Terms") govern all purchases made through tendy.se. By placing an order, you confirm that you have read, understood and accepted these Terms. We recommend that you save or print a copy for your records.
These Terms apply to consumers (private individuals) shopping for purposes outside their trade or profession. Separate terms apply to business customers (B2B); please contact hello@tendy.se for B2B terms.

2. Ordering and Agreement
When you complete an order, you receive an order confirmation by email containing the products, prices, billing information and delivery address. The binding sales agreement is formed when we send you the order confirmation.
If anything in the order confirmation is incorrect, please contact hello@tendy.se without delay.
We reserve the right to cancel or refuse orders, for example in cases of suspected fraud, pricing errors caused by technical faults, or where a product is unavailable. If we cancel an order, any payment already made will be refunded in full.
3. Prices, Payment and Currency
All prices on tendy.se are stated in SEK, NOK, EUR or DKK and include VAT. Shipping costs, where applicable, are added in the checkout and shown clearly before you complete your purchase.
We reserve the right to correct obvious pricing errors caused by typos, technical faults or incorrect information from suppliers. If a price has been clearly mistyped (for example, a price that is significantly lower than the market price), we are not bound by it and may cancel the order. You will be notified and refunded if applicable.
Tendy may run promotions such as "buy 3, pay for 2" or volume discounts. If you return one or more products from an order placed under such a promotion, the promotional price may no longer apply, and the discount will be recalculated based on the products you keep.
Available payment methods are shown in the checkout and may include Adyen, Klarna, Stripe, Swish, MobilePay and PayPal, among others. Payment is processed directly by the relevant payment provider; Tendy never stores your full card details.
4. Delivery
Our normal delivery times are:

Sweden: 1–3 business days

Rest of Europe: 1–8 business days
Orders placed on weekends or public holidays are dispatched on the next business day at the earliest.
Shipping is provided by partners including DHL, PostNord, UPS, Budbee, Posti, Bring, Instabox and Deutsche Post. The shipping cost is shown in the checkout.
Delivery is considered completed when the package has been received by you or by someone you have authorised. Risk of loss or damage transfers to you upon delivery.
If delivery is significantly delayed compared to what we have stated, please contact hello@tendy.se. You have the right to cancel the purchase if delivery is delayed and the delay is of significant importance to you, in accordance with the Swedish Consumer Sales Act (Konsumentköplagen 2022:260).
5. Right of Withdrawal (14 Days)
As a consumer, you have a statutory right of withdrawal of 14 days under the Swedish Distance Contracts Act (Lag 2005:59 om distansavtal och avtal utanför affärslokaler), counted from the day you (or someone you have appointed) received the goods.
5.1 How to exercise the right of withdrawal
To exercise your right of withdrawal, send a clear notice to hello@tendy.se before the 14-day period expires, stating:

You may also use the standard withdrawal form provided by the Swedish Consumer Agency (Konsumentverket), available at konsumentverket.se. Use of the standard form is optional.
After notifying us, you must return the products without undue delay and at the latest within 14 days of giving notice.
5.2 Return shipping
Tendy provides a prepaid return shipping label for products returned under the right of withdrawal within Sweden and the EU. After we have received your withdrawal notice, we will email you the return label and instructions.
A return handling fee of 99 SEK / 10 EUR / 99 NOK / 99 DKK applies to all returns under the right of withdrawal. This fee covers return shipping and processing. The fee is deducted from your refund once the returned product has arrived at our warehouse and been inspected.
If your order value is equal to or less than the return handling fee, no refund will be issued.
Products must be returned well packaged and, where reasonably possible, in their original packaging. You remain responsible for the products until they reach us, so please retain proof of postage and the tracking number.
The return handling fee does not apply to approved complaints under section 6 — Tendy covers all costs for defective products.
5.3 Refund
We will refund the purchase amount, less the return handling fee set out in section 5.2, within 14 days of receiving the returned goods. We use the same means of payment as the original transaction unless otherwise agreed.
The refund includes the standard shipping cost of the original order, but not any additional cost arising from your choice of a more expensive delivery method.
We reserve the right to deduct an additional amount corresponding to any decrease in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
5.4 Exceptions to the right of withdrawal
The right of withdrawal does not apply to the following products and circumstances:

Tendy app-connected products that have been paired with a user account. This includes Tendy Nemus, Tendy Scriptor, Tendy Fluctus, Tendy Scale, Tendy Lucus 4G and any other Tendy product that connects to the Tendy mobile or web application. Once a device has been paired with your Tendy account, it is registered to you and is no longer in unused, factory-new condition.

Products containing batteries where the security seal has been broken or removed. For safety, hygiene and product-integrity reasons, battery-containing products are sealed at the factory. Once the seal has been opened or removed, the right of withdrawal is lost.

Sealed audio, video, measurement or sensor devices where the seal has been broken after delivery.

Products sealed for hygiene or health reasons where the seal has been broken after delivery.
-
Custom-made or clearly personalised products produced or configured at your request.

Services that have been fully performed where you have given prior express consent and acknowledged that the right of withdrawal will be lost upon completion.
-
Digital content delivered other than on a physical medium where performance has begun with your prior express consent and acknowledgement that the right is lost.
The exceptions above apply only where they are permitted under the Swedish Distance Contracts Act and the EU Consumer Rights Directive. They do not affect your statutory right to complain about a defective product, which is described in section 6.

5.5 Uncollected packages
If you do not collect your package from the pick-up point, or if the courier is unable to deliver more than two times, the package is returned to us. The same applies if you have provided an incorrect address.
Failure to collect a package is not the same as exercising the right of withdrawal. In these cases we charge a handling fee of 99 SEK / 10 EUR / 99 NOK / 99 DKK to cover return shipping and administrative costs. This fee, together with the original delivery fee, is deducted from any refund. If your order value is equal to or less than this fee, no refund will be issued.
6. Right to Complain (Reklamationsrätt)
As a consumer, you have a statutory right under the Swedish Consumer Sales Act (Konsumentköplagen 2022:260) to complain about a defective product for up to three (3) years from delivery. You must report the defect to us within a reasonable time after discovering it; a complaint made within two (2) months of discovery is always considered to be within reasonable time.
The right to complain applies to original defects (defects present at the time of delivery, even if they appear later) and is separate from any voluntary product warranty. The right to complain applies in full to all products, including app-connected products and products with batteries, regardless of whether the seal has been broken or the device has been paired with a Tendy account.
6.1 How to file a complaint
Contact hello@tendy.se as soon as you have discovered the defect, stating:

Please contact us and obtain approval before returning the product.
We will assess the complaint and offer a remedy in accordance with applicable consumer protection law: repair, replacement, price reduction, or — where appropriate — a refund. Tendy covers the cost of return shipping for approved complaints and provides a prepaid return label. No return handling fee applies to complaints.
We reserve the right to refuse a complaint if it turns out that the product is not defective in the meaning of consumer protection law (for example, normal wear and tear or damage caused by misuse).
6.2 Transport damage
If your delivery arrives damaged, please:

Take photos of all damaged products.

Take photos of the inner and outer packaging showing damage in transit.

Email hello@tendy.se promptly with the photos and your order number.

Do not discard the product before we have given instructions on how to proceed.
Once we have received the documentation, we will replace the damaged item or provide an equivalent remedy.
7. Limitation of Liability
Tendy is liable in accordance with applicable mandatory consumer protection legislation. We accept no liability for indirect or consequential losses, except where such liability cannot lawfully be excluded.
We are not liable for delays or non-performance caused by circumstances beyond our reasonable control (force majeure), including but not limited to: industrial action, fire, war, pandemics, government decisions, transport disruptions, or material shortages or non-delivery from a supplier. Where such circumstances persist for more than 30 days, either party may cancel the affected order without liability beyond a refund of any amount paid.
We are not responsible for changes to product features made by suppliers after delivery, beyond what is required by mandatory consumer protection law.
8. Product Information
We reserve the right to correct printing errors on the website and at the final point of sale. We do our best to display products accurately, but cannot guarantee that images perfectly reflect actual appearance — minor colour variations may occur depending on screen, photo quality and resolution.
9. Personal Data and Privacy
Tendy AB is the controller for personal data processed in connection with your order and your use of our services.
A complete description of how we collect, use, share and protect your personal data — including your rights under the GDPR (access, rectification, erasure, restriction, data portability, objection, and withdrawal of consent) and how to exercise them — is set out in our Privacy Policy at tendy.se/privacy-policy.

10. Cookies
Our website uses cookies and similar technologies for strictly necessary, functional, analytical and marketing purposes.
Non-essential cookies are only set after you have given consent through the cookie banner on tendy.se, which is implemented using Shopify's Customer Privacy API and offers three equal options: Godkänn (Accept all), Avslå (Reject all) and Hantera inställningar (Manage settings). You can change or withdraw your consent at any time via the "Cookie settings" link in the website footer.
Our complete Cookie Policy is set out in section 13 of these Terms.
11. Amendments
We reserve the right to amend these Terms at any time. The current version is always available on tendy.se with the effective date shown at the top. Material changes will be communicated where required by law. The version of the Terms in force at the time you place your order applies to that order.
12. Disputes and Governing Law
If we are unable to resolve a complaint, you as a consumer can refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, arn.se. ARN handles disputes free of charge but applies minimum claim values and a one-year time limit from your first complaint to us. Tendy follows ARN's recommendations.
If you reside in another EU country, you may also file a complaint via the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
These Terms are governed by Swedish law. Disputes regarding the interpretation or application of these Terms shall be settled by Swedish courts, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
13. Cookie Policy

This Cookie Policy explains how Tendy AB ("Tendy", "we") uses cookies and similar technologies on the tendy.se website (including the online store) and on the public scan pages at links.tendy.se.
It supplements our Privacy Policy and should be read together with it. For information about how we process personal data more broadly, please see the Privacy Policy at tendy.se/privacy-policy.
13.1 What are cookies?
A cookie is a small text file that a website places on your device (computer, tablet, or mobile phone) when you visit it. Cookies allow the website to recognise your device, remember your preferences, and provide certain functions.
In this policy, the word "cookies" also covers similar technologies such as pixels, local storage, web beacons, and tags. Some of these technologies are not strictly cookies in a technical sense but they perform comparable functions.
13.2 Categories of cookies we use
We use the following categories of cookies, in line with the categorisation used by Shopify's Customer Privacy API and the European Data Protection Board's guidelines:
Strictly necessary cookies are essential to provide the website and the services you have requested. They cannot be disabled. They are used for things like logging you in, keeping items in your shopping cart, securing checkout, fraud prevention, and load balancing. The legal basis is Article 6(1)(b) GDPR (performance of a contract) and chapter 6 § 18 of the Swedish Electronic Communications Act, which exempts strictly necessary cookies from the consent requirement.
Functional / preferences cookies remember choices you make to personalise your visit, such as your language, country, currency, or recently viewed products. They are not strictly necessary, and we set them only after you have given consent.
Analytics cookies help us understand how visitors interact with our website (for example, which pages are most popular, how visitors move through the site, where they came from). We use this information in aggregated form to improve the site. They are set only after you have given consent.
Marketing cookies are used to deliver advertising that is more relevant to you, to limit how many times you see an ad, and to measure the performance of advertising campaigns. They may be set by us or by third-party advertising partners (for example Meta, Google, TikTok). They are set only after you have given consent and may involve sharing data with third parties.
13.3 How we obtain and manage your consent
When you visit tendy.se for the first time, you are presented with a cookie banner that asks for your consent before any non-essential cookies are set. The banner is implemented using Shopify's Customer Privacy API and offers three equal options:

Avslå (Reject all): decline all non-essential cookies. Only strictly necessary cookies will be set.

You can change your choice at any time by re-opening the cookie banner via the "Cookie settings" link in the website footer, or by clearing the cookies in your browser. Withdrawing consent will not affect the lawfulness of any processing carried out before the withdrawal.
Your consent is stored for up to 12 months. After that period, we will ask again.

13.6 How to manage and delete cookies
In addition to the choices you make in our cookie banner, you can manage cookies through your browser. Most browsers allow you to view the cookies stored on your device, delete some or all cookies, block cookies from particular sites or all sites, and be notified before a cookie is stored.

13.7 Cookies in the Tendy mobile app
The native Tendy mobile app does not use traditional browser cookies. It uses platform-level identifiers (for example Firebase installation IDs, advertising identifiers, and crash-reporting IDs) which serve similar purposes. These are described in our Privacy Policy.
13.8 Updates to this Cookie Policy
We update this Cookie Policy when our use of cookies or applicable law changes. The current version is always available at tendy.se/cookies, with the effective date shown at the top.
